Terms & Conditions

​Ts & Cs of All Fitness Classes UPDATED September 5th, 2023

Please ensure you adhere to the guidelines below.

Spaces are limited and strict adherence to maximum capacity is essential.

ALL SESSIONS:

  • Advance booking only

  • Please park respectfully in the car park.

  • Do not attend if you have been unwell with Covid-19.

  • Please bring your own mat & hydration.

  • Hand sanitiser available.

  • If you do not honour a booking you have made, the session is non-transferable.

Outdoor Sessions:

  • Bring your own mat. 

  • Bring weather appropriate clothing & extra ground protection.

  • If we have to cancel due to adverse weather conditions you will be informed an hour prior to the start of the class & issued a full refund.

  • Outdoor times are not set in stone as they are purely governed by the weather.

General

  • By agreeing to take part in classes, workshops and 1-2-1 sessions provided by Zestforlifefitness you agree to adhere to the following terms and conditions.

  • We will do our best to get you into your chosen class however classes are always subject to availability.

  • Zestforlifefitness accepts no liability for any injury occuring as a result of taking part in classes, workshops or 1-2-1 sessions.

  • The Par-Q and Health Screen must be completed prior to taking part in any sessions or classes.

  • By completing a PAR-Questionnaire you confirm to us that you have no known condition or are undergoing any treatment that would prevent you from being capable of physical exercise in all aspects.

  • When purchasing any classes you agree that you have no medical conditions that may affect your ability to exercise.

  • If you your health changes at any time during your time with Zestforlifefitness you must provide information of the details in writing.

  • Correct information will always be provided in all classes, workshops and 1-2-1 sessions.

  • Zestforlifefitness will sometimes take photographs/video footage for marketing purposes; if you have objection to this please inform the instructor at the time.

  • All intellectual property belongs to Zestforlifefitness, any infringements will be taken seriously.

 

Class Information

 

  • Details of class timetables and class times will vary from time to time and are published on our Website and Facebook. We reserve the right to change timetables, times or cancel appointments at our discretion, and will endeavour to give notice of such changes as is reasonably practicable.

  • You must at all times observe our guidelines which may be notified to you from time to time and you are requested to comply with any reasonable directions which Zestforlifefitness may issue to ensure the safety of all our Customers and the smooth operation of the facilities for the convenience of all Customers.

  • All fees and charges are subject to periodic increases and we reserve the right to change the costs of our services at any point.

  • We reserve the right acting under our sole discretion to refuse admission to the venue at any time.

 

Payment Policy

 

  • All sessions must be paid for in advance and are non-transferable & non-exchangeable.

 

Booking a Course/Block

  • Paying for a course of classes guarantees you a place in that designated class.

  • It is eligible for that course only and cannot be carried over to another block unless in exceptional circumstances.

  • Some classes have limited availability due to equipment & Health & Safety Regulations.

  • The instructor withholds the right to refuse attendance if the numbers are deemed unsafe.

  • We reserve the right to implement a waiting list if we feel it necessary to do so.

  • No refunds are issued for any blocks under any circumstances.

 

Booking Pay-As-You-Go

  • Pay-As-You-Go entitles you to attendance to any class, if there is availability. Ensure you check beforehand.

 

Cancellation Policy

 

Classes:

  • Zestforlifefitness PAYG sessions must be cancelled no less than 48 hours before the course start date & time.

  • If a session is cancelled with less than 48 hours’ notice, the session will be charged to the client.

  • The client will be charged the full amount for a class if it is cancelled with less than 48hrs notice. Cancellations will incur a £1 administration fee.

  • Block bookings are non-refundable.

  • A contract or class pass may be cancelled without notice if you commit a material breach of this agreement including, but not limited to, a breach of class rules, abuse or threatening behaviour or vandalism or other illegal activity.

  • We reserve the right to cancel any exercise class, 1-2-1 session if an instructor is unable to attend a session due to unavoidable circumstances.

 

1:1 Sessions:

  • All sessions must be pre-booked. A 24-hour cancellation policy is in place for 1:1 sessions.

  • Travel expenses are charged at 45p/per mile, from home address to venue & return.

  • You may reschedule the session with more than 24 hours’ notice.

  • If you do not show up for your scheduled session, you will lose it.

 

Class Safety & Etiquette

 

  • Please make sure you have the correct clothing/footwear to add to your comfort and personal safety.

  • Bring water to keep hydrated.

  • For security reasons you are advised to take personal belongings and valuables with you and not leave them unattended.

  • In the interests of safety and hygiene, no crockery, glass, or food are permitted in the facilities. No alcohol is permitted within the fitness area. Please bring your own water bottles and water (preferably non- coloured drinks). No pets (except for guide dogs) are permitted in the facility. You must use the main entrance when entering or leaving the facilities. Fire exits, which are clearly marked, are there in the interests of safety and you must not interfere with these doors for any reason. Smoking is not permitted.

  • You are required to bring and use a suitable towel for covering gym equipment or class mats in cases of perspiration.

  • In the event of a fire, you are asked to make your way to the nearest available exit.

  • The format of each session starts with a warm up, main work sets followed by cool down.

  • Trainers must be worn in all fitness classes to avoid risk of injury. If you forget your trainers, it is up to the instructor whether they will let you in the class and you will do so at your own risk.

  • Pilates classes can be done barefoot or in socks if preferred.

  • If you have any contagious foot complaints, please make sure you are wearing socks at all times.

  • You also acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries.

  • You further acknowledge that the specific risks vary from one activity to another, but range from:

    • minor injuries such as scratches, bruises, and sprains; major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and catastrophic injuries including paralysis and death. At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by trainers and staff. In consideration of being allowed to participate in and access the Zestforlifefitness services, you hereby agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to Zestforlifefitness and release, indemnify, and hold harmless Zestforlifefitness, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Zestforlifefitness and  represent that you have no medical or physical condition that would prevent you from properly exercising at Zestforlifefitness and do not have a physical or mental condition that would put you in any physical or medical danger, and have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in participating in Zestforlifefitness and should not be participating in any classes unless otherwise advised by your doctor.

 

Your Health & Ability to Exercise

 

  • You are responsible for your own health and therefore advised to seek approval from your own G.P prior to attending an exercise class with us or performing any activity with us in person or online.

  • We are not medically trained and are therefore not qualified to assess whether you are in good physical condition and/or that you can engage in any exercise without detriment to your health, safety, comfort or physical condition.

  • You are advised not to undertake any physical activities without first seeking medical advice and if you have concerns over your physical condition you must seek medical approval first prior to exercising.

  • We reserve the right to refuse access to any Customer if, in our absolute discretion, we consider that the health of the individual concerned may be endangered by the use of our facilities.

  • Your health is your own responsibility.

 

Our commitment to you

 

  • We will make every reasonable effort to make sure that our exercise facilities are in a safe condition for you to use.

  • We will take all reasonable steps to make sure all our staff are qualified to the fitness industry standards set out by the register of exercise professionals.

  • We will respect your own personal decisions. You do not have any obligation to follow what our instructors advise you to do. We will however ask you not to exercise beyond what we think are your own abilities.

  • All our instructors are fully insured and will continue to take all reasonable steps to ensure their practice is up-to-date.

 

Your commitment to us

 

  • You should always exercise in a safe manor. You should exercise to your own abilities. If you are concerned or know that you may have a medical condition that may affect your training before you use our facility you should seek medical advice prior to starting an exercise programme or session.

  • If you feel ill when exercising you should let us know immediately. Our instructors are not doctors but are first aid qualified.

  • If you have a disability you must follow any reasonable instruction to allow you to train in a safe environment.

  • You should make yourself aware of any rules or instructions within the venue. There are risks when exercising. You should not undertake any exercises that you have been told are not suitable for you.

  • Group exercise has multiple social benefits to wellbeing. Therefore we would ask you to respect others within that space & ask you to contribute to making it a  positive experience for everyone involved.

 

 

Privacy & Data Protection Policy

 

  • We (‘Zest For Life Fitness’) collect information via our ParQ (Participant Questionnaire) form which you will have or will be asked to complete before you start any activity with us. This information (name, email, telephone numbers,) remains on the paper form that you fill in and is kept securely by individual instructors in a locked filing system.

  • It may prove to be necessary to make a private file note regarding any medical implications that we need to be cautious of with regards to your exercise performance and will be stored along with the ParQs

  • We require any personal or medical information to be communicated to us via telephone, face to face meetings and through our ParQ form. This type of sensitive information must not be communicated electronically. If you communicate personal or medical information via email it will be destroyed on receipt.

  • None of the personal information you give us is shared with anyone else and is never entered into an electronic data base. By completing the ParQ form and giving us your consent we will use your email address and telephone number to contact you about upcoming events and any changes to timetabled classes. Your email address and telephone number will not be shared under any circumstances with any third parties or between individual instructors at Zest For Life Fitness unless you specifically allow us to do so.

  • Zestforlifefitness collects email addresses and certain other Personal Information to contact you about classes, events and occasions and other informations that might be of interest to you. You can review, amend or ask to have this information deleted by email zestforlifefitness@gmail.com

  • We will keep, as required by law, your personal information and contact details for 7 years after you cease to attend activities with us.

  • Zestforlifefitness do not store any card details. Our online booking is a secure facility that is completely separate and as such no data is electronically stored or ever sent over the internet.

  • We do not use any third parties except Stripe for secure online payments and My Fitness Class for online booking.

  • We  do  not  share  or  sell  your  information  to  third  parties.

  • Zestforlifefitness staff are bound by an agreement to abide by all data protection legislation and have no right of access to your details other than for work.

  • We  do  not  send  spam.

  • Governing Law. These terms and conditions are governed by the laws of England and Wales, and any disputes shall be resolved in the courts of England and Wales.

We have the right to revise and amend these Terms and Conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.
